Minutes of Regular Meeting No. 821 Held in the Lake Elmo City Council Chambers

MANAGERS PRESENT: Lincoln Fetcher, President; Dave Bucheck, Vice President; Don Scheel, Secretary; Dale Borash, Treasurer; and Ray Lucksinger, Manager

MANAGER ABSENT: None

STAFF PRESENT: John Hanson, Barr Engineering; Barbara Wolle, Attorney

STAFF ABSENT: Ray Roemmich, Inspector

OTHERS PRESENT: Don Buckhout and Melissa Lewis, Minnesota Board of Water and Soil Resources

  

CALL TO ORDER President Fetcher called the meeting to order at 7:08 pm. Motion was made by Fetcher and seconded by Bucheck to suspend the regular meeting. Motion carried unanimously.

RECONVENE At 8:39 p.m., motion was made by Fetcher and seconded by Borash to reconvene the regular meeting. Motion carried unanimously.

ANNOUNCEMENTS There were no announcements.

APPROVAL OF MINUTES After discussion of the minutes of the July 9, 2009 meeting, motion was made by Scheel and seconded by Borash to approve the minutes as corrected. Motion carried unanimously.

ADDITIONAL AGENDA ITEMS Item added to the agenda under Engineer: Stormwater Pond EC-9. Item added under Managers: Karen Schultz Remembrance.

PUBLIC FORUM There was no discussion in Public Forum.

SECRETARY'S REPORT Secretary Scheel reported that he was not allowed to pick up the mail without a key. Vice President Bucheck volunteered to use the key held by Recording Secretary Schultz to obtain the mail and determine what is necessary to pick up the mail without the key.

INSPECTOR'S REPORT Inspector Roemmich was absent from the meeting.

ATTORNEY'S REPORT Attorney Marshall had emailed copies of letters the South Washington Watershed District attorney had sent regarding the Woodbury Appeal of BWSR's Order to Enlarge South Washington Watershed District and VBWD. President Fetcher directed Attorney Wolle to prepare similar letters.

TREASURER'S REPORT Treasurer Borash distributed copies of the Administrative and Program Budgets for Fiscal Year 2009 dated June 30, 2009, and the Treasurer's Report dated July 23, 2009. After discussion, motion was made by Fetcher and seconded by Borash to approve the Treasurer's Report. Motion carried unanimously.

WASHINGTON CONSERVATION DISTRICT No report was given.

ENGINEER'S REPORT Permit Request: Tablyn Park Entrance, Lake Elmo Engineer Hanson had mailed to the managers a permit review memorandum regarding a proposed project located south of Stillwater Boulevard between 31st Street North and Inwood Avenue North, Lake Elmo, in part of the northeast 1/4 of Section 21, Township 29 North, Range 21 West.

The purpose of the project is to resurface the existing parking lot and entrance. The project involves constructing a rainwater garden.

After discussion, motion was made by Bucheck and seconded by Borash to approve Permit # 2009-22 with the engineer's suggested site-specific conditions and standard conditions as revised. Motion carried unanimously.

St. Croix Watershed Research Station WOMP Work Plan Approval Engineer Hanson had mailed to the managers a letter that approved the proposal submitted by Dr. Jim Almendinger at the July 9, 2009 managers'meeting. Motion was made by Fetcher and seconded by Borash to approve the letter. Motion carried unanimously.

Stormwater Pond EC-9 Engineer Hanson reported that Barr Engineering has been monitoring the water levels of ponds in Mahtomedi, letters were sent and emailed to property owners around stormwater pond EC-9, and President Fetcher has set up an email account with the address valleybranchwd@gmail.com.

MANAGERS'REPORT Next Meeting - August 13, 2009 The managers expect to have a quorum at the next meeting.

Recording Secretary Position The managers discussed how to proceed in hiring a recording secretary. After discussion, motion was made by Fetcher and seconded by Scheel to place an ad in local newspapers as discussed. Motion carried unanimously. Engineer Hanson was directed to place the ads and coordinate the process.

2010 Budget and Levy President Fetcher reported that he will meet with Engineer Hanson next week to start drafting a 2010 budget and levy.

Karen Schultz Remembrance President Fetcher led a discussion on possibilities for remembering Recording Secretary Schultz, who died suddenly on July 15, 2009. After discussion, the managers agreed to have President Fetcher talk with the minister at Karen's church about planting a tree in Karen's honor.

ADJOURNMENT Motion made by Borash and seconded by Lucksinger at 9:55 pm to adjourn the meeting. Motion carried unanimously.
