Minutes of Regular Meeting # 784 Held in the Lake Elmo City Council Chambers
Thursday, November 8, 2007 

MANAGERS PRESENT:  Lincoln Fetcher, President; Dave Bucheck, Vice President; Don Scheel, Secretary, and Dale Borash, Treasurer; and Duane Johnson, Manager

MANAGERS ABSENT: None

STAFF PRESENT: John Hanson, Barr Engineering; Ray Marshall, Attorney; and Karen Schultz, Recording Secretary

STAFF ABSENT:  Ray Roemmich, Inspector

OTHERS PRESENT:  Chuck Taylor, Citizens Advisory Committee; Keith Pilgrim, Barr Engineering; Brian Buchmayer and Bill Feely, Long Lake Residents; Ray Lucksinger, newly appointed VBWD manager

 

At 6:00 pm, the managers met with Angie Hong, their water resources educator, and Jay Riggs, the Washington Conservation District Manager, to discuss the status of the VBWD's Education Program and the East Metro Water Resources Education Program after being in operation for one year.

CALL TO ORDER President Fetcher called the meeting to order at 7:08 pm.

ANNOUNCEMENTS President Fetcher introduced the new manager, Ray Lucksinger, from West Lakeland Township, who was appointed to a three-year term to replace Manager Duane Johnson, who did not seek reappointment.

President Fetcher presented Manager Johnson with a plaque in appreciation of his service on the Board of Managers since he was appointed in 2000.

APPROVAL OF MINUTES After discussion of the minutes of the October 25, 2007 meeting, motion was made by Fetcher and seconded by Borash to approve the minutes as corrected. Motion carried unanimously.

ADDITIONAL AGENDA ITEMS Added to the agenda under Managers: MAWD Annual Conference.

PUBLIC FORUM There was no discussion in the Public Forum segment of the meeting.

SECRETARY=S REPORT Secretary Scheel reported that the mail had been distributed.

INSPECTOR=S REPORT Inspector Roemmich was absent. No report was given.

ATTORNEY=S REPORT Mark Mann Infiltration Basin Attorney Marshall reported that an earnest money contract in the Mark Mann issue is being prepared and signed, and he expects it to be completed soon. Tim Freeman of Folz, Freeman, and Erickson, will complete the land survey in a couple weeks.

Park Meadows Attorney Marshall reported that Attorney Wolle has been assured that the City of Lake Elmo will not issue any building permits until the developer of Park Meadows is in compliance with the VBWD=s permit requirements.

TREASURER=S REPORT The Treasurer=s Report is given at the second meeting of the month. Treasurer Borash informed the managers that the District=s Auditor, Tautges Redpath, has requested authorization to perform the 2007 audit for the District at a cost of $8,500. After discussion, motion was made by Fetcher and seconded by Scheel to authorize Tautges Redpath to perform the 2007 VBWD Audit. Motion carried unanimously. Treasurer Borash will sign the authorization form and return it to the auditor.

ENGINEER=S REPORT Long Lake, Sunfish Lake, and Eagle Point Lake Water Quality Assessments Engineer Hanson had mailed reports titled AWater Quality Assessments of Long, Sunfish and Acorn Lakes@ to the managers and staff. At this meeting, Keith Pilgrim, with Barr Engineering, presented the information to the managers and answered their questions regarding these lakes. Brian Buchmayer, President of the Long Lake Association, was present, and requested that this presentation be made at an Association meeting. The managers thanked Keith Pilgrim for the excellent presentation, and the managers asked him to make the same presentation at a Long Lake Association meeting. Keith said he would be happy to make the same presentation at a Long Lake Association meeting.

Oakgreen Avenue Infiltration Basin Project Engineer Hanson had mailed to the managers a draft set of the contract documents for the project on Mark Mann=s property. At this meeting, Engineer Hanson requested from the managers authorization to finalize the plans and specifications.

After discussion, motion was made by Scheel and seconded by Fetcher to authorize Engineer Hanson to finalize the plans and specifications for the Oakgreen Avenue Infiltration Basin Project, to advertise the project with a bid opening before the Managers= December 13th meeting, and to apply for the necessary permits from the City of Afton. Motion carried unanimously.

Valley Creek Bank Stabilization Projects Engineer Hanson had mailed to the managers a draft set of plans for stabilizing an upstream reach of Valley Creek on several properties, and at the meeting, updated the managers. He said Barr staff will be meeting with the property owners and the DNR to review the plans and possibly make revisions based on these meetings.

Engineer Hanson had mailed to the managers a memorandum dated November 2, 2007, regarding a revised concept for stabilizing Valley Creek downstream of Putnam Boulevard on the Tom Johnson property. The managers agreed that Barr Engineering should continue to meet with these property owner.

Torre Pines Grading Engineer Hanson said he had met with property owner Randall Adam of the west side of the drainage easement. He said if the managers agree, he will work with Mr. Buelow of Buelow Excavating to do the work. After discussion, motion was made by Johnson and seconded by Borash that Engineer Hanson should work with the property owners, the City of Lake Elmo, and Mr. Buelow to have the work done. Motion carried unanimously.

2007 Stormwater Pond Maintenance  Engineer Hanson had mailed to the managers a memorandum from Scott Sobiech, Barr Engineering, which explained the status on the 2007 pond maintenance project in VBWD. Barr Engineering is still working toward the goal of having the construction occur over winter. Engineer Hanson asked for authorization to get sediment samples at points listed in the memorandum. After discussion, motion was made by Scheel and seconded by Borash to authorize Engineer Hanson to have the work done. Motion carried unanimously.

Oakdale Local Surface Water Management Plan Engineer Hanson had mailed to the managers a letter from the City of Oakdale asking for an extension in time to November 10, 2007, to complete the City=s Surface Water Management Plan Update. After discussion, the managers agreed with the extension of time for the City of Oakdale to complete its Surface Water Management Plan, on the condition that the city=s ordinance be updated to be consistent with the VBWD rules and regulations by April 15, 2008.

2007 Summary of Achievements in Washington County Groundwater Management Engineer Hanson had mailed to the managers a draft list of VBWD=s 2007 groundwater achievements. Washington County has requested a list of achievements by each water management organization in implementing the County=s Groundwater Plan. The managers agreed with the list of achievements.

Rockpoint Church Engineer Hanson had mailed to the managers a letter from Rockpoint Church dated October 8, 2007, requesting that the managers close out the VBWD permit and release the Letter of Credit securing the permit. Engineer Hanson said the permit holder should submit an as-built of the entire site and proof that all of the required recordings have been done. The managers agreed.

Trespass Within West Lakeland Storage Site Engineer Hanson had mailed to the managers information that a landowner reported trespassing in the West Lakeland Storage Site. The trespassers have been riding 4-wheelers in the area. Engineer Hanson said that Barr employees have inspected the site as part of Barr=s inspection of Project 1007. Engineer Hanson showed photographs that Treasurer Borash had taken of the area.

Attorney Marshall suggested the managers meet with West Lakeland Township officials and residents to discuss the problem. The managers agreed with this. President Fetcher directed Attorney Marshall and Treasurer Borash to organize the meeting.

Echo Lake Townhomes Engineer Hanson had mailed copies of a letter to the managers, regarding the Echo Lake Townhomes in Mahtomedi, and the items that need to be addressed before the VBWD will call the project complete and close Permit # 2005-11.

MANAGERS= REPORT Next Meeting - December 13, 2007 The managers expect to have a quorum at the next meeting.

MAWD Annual Conference President Fetcher indicated that he plans to attend the annual conference. As a new manager, Ray Lucksinger may also attend. Motion was made by Borash and seconded by Scheel to appoint President Fetcher the voting delegate at the MAWD Conference. Motion carried unanimously.

ADJOURNMENT Motion made by Bucheck and seconded by Borash at 10:09 pm to adjourn the meeting. Motion carried unanimously.
