Minutes of Regular Meeting # 705 Held in the Lake Elmo City Council Chambers
Thursday, April 22, 2004

MANAGERS PRESENT:  Lincoln Fetcher, Vice President; Don Scheel, Secretary; and Dale Borash, Treasurer; and Duane Johnson, Manager

MANAGER ABSENT: Dave Bucheck, President

STAFF PRESENT: John Hanson, Barr Engineering; Barb Wolle, Attorney; Ray Roemmich, Inspector; and Karen Schultz, Recording Secretary

STAFF ABSENT: None

OTHERS PRESENT: Jeff Berg, Washington Conservation District; Richard Welch, Anna's Grove

CALL TO ORDER Vice President Fetcher called the meeting to order at 7:02 p.m.

ANNOUNCEMENTS There were no announcements.

APPROVAL OF MINUTES After discussion of the minutes of the April 8, 2004 meeting, motion was made by Scheel, seconded by Borash, to approve the minutes as amended. Motion carried unanimously.

ADDITIONAL AGENDA ITEMS Additional Items to the agenda: Under Engineer: 3. Wetland Conservation Act Exemption Request from the City of Oakdale; 4. Meeting Attendance Request from City of Afton.

PUBLIC FORUM There was no discussion in the public forum segment of the meeting.

SECRETARY=S REPORT Secretary Scheel reported that he had distributed the mail.

INSPECTOR=S REPORT Inspector Roemmich said he will begin checking on the projects that are completed and still active, in order to close out the record on the projects. He said when he needs to contact someone regarding a project, it is difficult to locate the person responsible for the project because the building or land has been sold, etc. He suggested that the permit fee could be raised, making it more likely that the permit holder would stay in contact with the District. After discussion, the managers directed Engineer Hanson to gather some data that shows the current structure of permit fees, for discussion at the next meeting.

ATTORNEY=S REPORT Attorney Wolle said she had nothing to report.

TREASURER=S REPORT Treasurer Borash distributed copies of the Administrative and Program Budgets for Fiscal Year 2004 dated April 30, 2004, and the Treasurer=s Report dated April 22, 2004. After discussion, motion was made by Borash and seconded by Scheel to approve the Treasurer=s Report. Motion carried unanimously.

ENGINEER=S REPORT MS4 Annual Report After the public hearing on the stormwater pollution prevention plan, Engineer Hanson prepared a letter to forward the VBWD annual report for its Municipal Separate Storm Sewer Systems (MS4) permit. Motion was made by Scheel and seconded by Johnson to authorize Vice President Fetcher to sign the letter. Motion carried unanimously. Vice President Fetcher signed the letter.

Permit Request from City of Oakdale Engineer Hanson reported that the City of Oakdale requests a Wetland Conservation Act exemption for a minor amount of wetland fill along Georgia Boulevard. The City is proposing to reconstruct the road and replace culverts. In doing so, a minor amount (less than 400 square feet) of wetland will be impacted. After discussion, motion was made by Borash and seconded by Johnson to grant exemption to the City of Oakdale for the minor wetland fill. Motion carried unanimously.

Meeting Attendance Request from City of Afton Engineer Hanson reported that citizens in Afton have organized to voice their concerns regarding the Valley Creek Community housing development. A letter listing some of their concerns was signed by about 65 residents. In an attempt to try to address the concerns, the Afton City Council will hold a workshop at 6:00 p.m. on Monday, April 26 and has invited units of government to attend, including VBWD. Vice President Fetcher said the VBWD has no particular stance on the proposed project, so VBWD representation would not be necessary.

Richard Welch - Anna=s Grove Issues Richard Welch, a resident of Anna=s Grove, was present to inform the managers of a proposed development on the property known as the Raleigh property, which is north of the Anna=s Grove subdivision. He distributed information to the managers regarding a special use permit request for the placement of fill on the property. A petroleum pipeline crosses the property from north to south. He said the proposed project has environmental issues, as well as safety issues. Mr. Welch is concerned about the impact on Raleigh Creek.

Vice President Fetcher said the VBWD has not been contacted about the proposed project, which is a 400,000 square foot building. After much discussion, Vice President Fetcher directed Inspector Roemmich and Engineer Hanson to investigate the site to ensure erosion controls are in place.

MANAGERS= REPORT Next Meeting - May 13, 2004 The managers expect a quorum to be present on May 13th . Vice President Fetcher said he will be absent. Treasurer Borash said it is possible that he will also be absent.

Sunnybrook Lake Vice President Fetcher said he and Engineer Hanson had a good meeting with the Browns Creek Watershed District managers and staff on April 12, 2004. He said that some managers were supportive of the project, and others were not. There was discussion of whether the project would need to involve Browns Creek Watershed District.

2003 Annual Report The recording secretary said she has made some of the required changes in the 2003 Annual Report, but that she still needs the budget figures for the 2004 proposed budget. Treasurer Borash said he will provide that for the report.

ADJOURNMENT Motion made by Borash and seconded by Scheel at 8:48 p.m. to adjourn the meeting. Motion carried unanimously.
