The managers held a workshop for two hours beginning at 6:00 p.m.
CALL TO ORDER President Bucheck called the meeting to order at 8:13 p.m.
ANNOUNCEMENTS Treasurer Borash announced that he has been reappointed for a three-year term by the Washington County Board of Commissioners.
President Bucheck said he had received a telephone call from Mr. Richard Welch, Anna=s Grove, who was very happy to receive the requested data from Engineer Hanson, and he thought it was very good information, and he said he is much more confident that he won=t get flooded out.
APPROVAL OF MINUTES After discussion of the minutes of the September 11, 2003 meeting, motion was made by Scheel, seconded by Borash, to approve the minutes as corrected. Motion carried unanimously.
ADDITIONAL AGENDA ITEMS There were no additional agenda items.
PUBLIC FORUM There was no discussion in the public forum segment of the meeting.
SECRETARY=S REPORT Secretary Scheel reported that he had distributed the mail.
INSPECTOR=S REPORT Inspector Roemmich reported that Michelle Kuss, the property owner in Afton who had bulldozed her property to remove buckthorn, has started putting down a filter blanket for erosion control. He also said that he has been checking on each of the District=s permitted projects, for the progress of each one. The managers said it would be helpful if there was a list of permits issued available for the managers to review. Engineer Hanson said he could make that available, and Inspector Roemmich said he will also show the managers the map/list system that he uses.
ATTORNEY=S REPORT Attorney Wolle said she had nothing new to report.
TREASURER=S REPORT Treasurer Borash distributed copies of the Draft Administrative and Program Budgets for Fiscal Year 2003 dated September 30, 2003, and also copies of the Treasurer=s Report dated September 25, 2003. He reminded the managers and staff that per diems and expense accounts should be submitted as soon as possible. Motion was made by Fetcher and seconded by Borash to approve the Treasurer=s Report. Motion carried unanimously.
ENGINEER=S REPORT Silver Lake Bioretention Project Engineer Hanson had mailed a memorandum to the managers concerning the problems at the Silver Lake bioretention basin due to the rain on September 11th. In the memorandum he explained that Barr Engineering staff had met with Scott Dudeck of the City of North St. Paul, at the site to inspect the conditions after a 2.5 to 3-inch rainfall. He said that they observed that a five to ten-foot portion of the embankment adjacent to Silver Lake had failed, resulting in sediment overtopping the silt fence and spilling into the lake. The City of North St. Paul has made arrangements with a contractor to perform emergency repairs. Conditions will improve once vegetation has established and the embankment soils have time to consolidate. Engineer Hanson recommended that the basin should be monitored during the next year with periodic visits by Barr staff, and/or Vice President Fetcher, who lives near the basin.
The managers agreed that the problem is with the construction, not the design of the basin, and agreed to give it time.
FEMA Floodplain Study Engineer Hanson had mailed to the managers a summary table of the study of the current VBWD 100-year flood levels. He said that Washington County has received a grant to prepare flood levels of streams in the county, and have indicated that Eagle Point Creek and/or Valley Creek would be studied. The grant is for $60,000, which is not enough money to study both creeks. Engineer Hanson said that if VBWD contributes some money, topography mapping could be obtained from Washington County for the entire District. The managers asked Engineer Hanson to invite Ann Pung-Terwedo to a managers= meeting to discuss the County=s grant and stream study.
Lake Elmo Regional Park Wetland Assessment At a previous meeting the managers authorized Barr Engineering and the Washington Conservation District to develop a wetland management plan for the Lake Elmo Regional Park. Engineer Hanson distributed copies of the report on the plan. The managers did not have any discussion on the report at this meeting, but asked for a presentation at a future meeting.
Miscellaneous Updates
Winkels Property/Legion Pond, Lake Elmo As authorized by the managers at the last meeting, Engineer Hanson attended a meeting on September 16, 2003, with the City of Lake Elmo, and Ms. Winkels to discuss the Winkels property on Legion Pond, which is in a floodplain. The City of Lake Elmo indicated that if a berm is constructed which would remove the property from the floodplain, the City would likely approve the addition to the Winkels home. Ms. Winkels said she will be in contact with the neighboring property owners regarding the berm.
Meth Lab Wetland Impacts, Oakdale Engineer Hanson had electronically mailed a memorandum to the managers concerning a meth lab found in a family=s home in Oakdale within the VBWD. He said he visited the site, and said no obvious signs of wetland contamination were found.
Washington County is taking the lead in the investigation. Engineer Hanson distributed a letter from the County regarding the property. He said he will keep the managers informed on the issue.
Mills Fleet Farm Petroleum Release-Wetland Impacts, Oakdale Engineer Hanson had electronically mailed a memorandum to the managers regarding a 3,000-gallon leak of petroleum product at the Mills Fleet Farm site in Oakdale. The leak was discovered on Wednesday, September 24th, and is under investigation. The product leaked into a wetland along Highway 36, southeast of the Mills Fleet Farm business. Engineer Hanson said actions have been taken to contain the leaked product. The wetland has been excavated to prevent further contamination, and an after-the-fact permit will be requested form the VBWD.
LCMR Groundwater Study/Woodbury Wells Engineer Hanson said that Washington County will soon be sending a Request for Qualifications for a consultant to develop a model of the southern Washington County area to specifically determine the impacts of proposed Woodbury wells on Valley Creek. This is the study that received an LCMR grant. The groundwater model will need to have the ability to address other issues. He said the managers may receive a letter requesting representation on the selection committee.
Sunnybrook Lake President Bucheck distributed copies of a Sunnybrook Lake Plan Framework-Draft 1 for the managers to review for the next meeting.
Northbrook Boulevard Manager Johnson asked about the status of Northbrook Boulevard. Engineer Hanson informed the managers that Baytown Township has requested a letter from VBWD concerning whether the wetlands on site were impacted with fill by the unpermitted shoulder expansion on Northbrook Blvd. The Township needs the letter to present to the Minnesota Pollution Control Agency (MPCA) so that it doesn=t get fined another $2,000. Engineer Hanson said that so far, there are no fill impacts and he has drafted a letter to the MPCA which includes that information.
MANAGERS= REPORT Next Meeting - October 9, 2003 The managers expect to have a quorum at the next meeting.
