Minutes of Regular Meeting # 670 Held in the Lake Elmo City Council Chambers

CALL TO ORDER Meeting called to order by President Borash at 7:00.

ANNOUNCEMENTS There were no announcements.

APPROVAL OF MINUTES After discussion of the minutes of the July 25, 2002 meeting, motion was made by Scheel, seconded by Bucheck, to approve the minutes as distributed. Motion carried unanimously.

ADDITIONAL AGENDA ITEMS Additional agenda items are as follows: F.4. Downs Lake.

PUBLIC FORUM Request for Rule Change Tim Freeman, with Folz, Freeman, and DuPay Surveying, distributed copies of a paper regarding a change in the VBWD rules concerning the minimum floor elevation. He asked the managers to consider the proposed rule change, and asked to be put on the agenda for the next meeting on August 22, 2002, to discuss the issue. The Board agreed to do this.

Norm Dupre, Bay Lake, Baytown Township Norm Dupre was present to describe to the managers, using a two-foot topographic map, the land in Baytown Township that he owns, and wants to sell to developers. He has appeared before the managers at previous meetings to discuss the 100-year flood level that is set in the area. His complaint is that the level is not accurate. He said he has hired an engineering firm to study the issue. Vice President Bucheck explained that when the engineering firm completes its study, and if the study determines that the 100-year flood level is different than what the VBWD has determined, the issue can be discussed at a future meeting.

CITIZENS’ ADVISORY COMMITTEE Chuck Taylor had mailed the lake level report to the managers, and discussed it with the managers at the meeting.

SECRETARY’S REPORT Secretary Scheel said he had no mail to distribute.

INSPECTOR’S REPORT Inspector Roemmich reported on the inspections he has made since the last meeting.

ATTORNEY’S REPORT Attorney Marshall said there was nothing new to report.

TREASURER’S REPORT Treasurer Fetcher said he had nothing new to report. He said he will discuss the 2003 budget later in the meeting.

ENGINEER’S REPORT Sunnybrook Lake Update Engineer Hanson reported that the Sunnybrook Lake level is high and almost over Jocelyn Road. He said the model for the Sunnybrook Lake area has been revised for a better calibration. He had prepared a summary of cost estimates for alternative solutions to the Sunnybrook Lake flood issue. The managers discussed the alternatives. They then authorized Engineer Hanson to complete a model of an option that would optimize the existing storage between Sunnybrook Lake and Keats Pond without conveying water east and out of Keats Pond. The managers directed Engineer Hanson to determine the necessary easement areas based on the modeling, and to work with Attorney Marshall to get better estimates on easement costs. The managers also directed Engineer Hanson and Attorney Marshall to begin to prepare preliminary plans and specifications for a project that will optimize the existing storage between Sunnybrook Lake and Keats Pond.

USPS, Oak Park Heights Engineer Hanson said that some repairs are needed at the site of the U.S. Post Office in Oak Park Heights. A VBWD permit had been issued for the Post Office Building in 2000. Some erosion issues persist, and the post office officials were notified of the problems. The post office officials have asked the VBWD to find a contractor, get an estimate, do the repairs, and charge the post office. After discussion of the issue, the managers authorized Engineer Hanson to get the estimate for the repairs, and inform the post office officials of the cost, before beginning any repair work.

Downs Lake Engineer Hanson informed the managers that Dave Dupay of Folz, Freeman, Dupay and Associates, notified him that the right-of-way on Manning Trail is not as wide as shown on the mapping information that the District had obtained from Washington County. The proposed pipe will not fit within the existing right-of-way, so an additional easement will be needed. Engineer Hanson reported that he had given Mr. Dupay a drawing of the proposed pipe and dimensions of the needed easement. Mr. Dupay agreed to work with Attorney Marshall to describe the easement, work with Tartan Park officials in obtaining the easement, and get the easement recorded.

Highlights of the Valley Creek Subwatershed Plan Engineer Hanson presented the highlights of the Valley Creek Subwatershed Plan to the managers, as previously requested. His presentation generated a lengthy discussion of Valley Creek and the area. The managers thanked Engineer Hanson for the interesting presentation.

MANAGERS’ REPORT Next Meeting - August 22, 2002 The managers said they do expect to have a quorum at the next meeting. President Borash said he may not be present.

2003 Budget Discussion Treasurer Fetcher distributed copies of the proposed budget draft for 2003, which the managers discussed. Engineer Hanson and President Borash will meet with Treasurer Fetcher on August 12th to make final decisions on the proposed budget for the managers’ approval at the next meeting. Motion was made by Scheel and seconded by Treasurer Fetcher authorizing Attorney Marshall to publish notice of the public hearing on the 2003 proposed administrative budget to be held September 12th, 2002. Motion carried unanimously.

ADJOURNMENT Motion made by Fetcher and seconded by Bucheck at 10:01 p.m. to adjourn the meeting. Motion carried unanimously.
